Brad Biddle has a 60 page law review article "Misplaced Priorities: The Utah Digital Signature Act and the Neglected Policies of Consumer Protection and Economic Integrity." The article will be appearing in volume 33 of the San Diego Law Review in September. The article focuses primarily on the issue of liability allocations and burdens of proof in the Utah Act.

Mr. Biddle also says

The National Conference of Commissioners on Uniform State Laws (NCCUSL), the folks that developed the Uniform Commercial Code and many other laws, are working on an "electronic contracting" statute that, in my opinion, will be far superior to the Utah law. I would strongly encourage any legislature looking at this issue to wait and consider alternative approaches rather than adopt a deeply flawed model.
